These days Microsoft with Nokia , HTC and Sony Erricson has moved its legal battle over the apple’s “App Store” trademark.
These four companies have filed a formal complaint against europian trademark authorities in the community trademark office for the declaration of invalidity against Apple’s trademarks for “App Store” and “Appstore” .
Apple has successfully trademarked their terms ‘appstore’ and ‘app store’ through OHIM (Office fοr Harmonization іn thе Internal Market) but Microsoft, Nokia, HTC and Sony Erricson are opposing and want OHIM to take its decision back because of the reason that these terms “lack distinctiveness”.
A Microsoft representative said in a statement that ‘toy store’ or ‘book store’ are the general terms that should be availed for everyone to use for these types of companies that sell apps.
Apple is already dealing with a challenge by Microsoft at the trademark appeals board, and has filed a lawsuit in federal court against Amazon, which recently announced its intention to open an Amazon store for apps called “appstore.”
Also In March, ‘Apple sued Amazon’over its Amazon Appstore, arguing that Apple has the exclusive rights to the phrase because of its iTunes App Store but last month Amozon responded against this suit that term “appstore” is very general and its not only the ‘Apple’ which should be allowed to use it exclusively.
